The Americans with Disabilities Act (ADA), which passed in 1990, calls for removing all barriers that deny individuals with disabilities equal opportunities in all aspects of life. Title I of the ADA prohibits discrimination against qualified individuals with disabilities in the workplace with regard to all terms, conditions, and privileges of employment. Title II mandates that public entities accommodate persons with disabilities to ensure their participation in services, programs, and activities. Both titles require courts to modify policies, practices, and procedures to prevent disability discrimination; remove architectural and communication barriers; and provide accessible services. These requirements have forced court systems across the country to confront difficult questions regarding how best to accommodate individuals with disabilities and improve their access to the courts. A grant from the Department of Justice enabled the National Center for State Courts to establish an ADA Resource Center for State Courts. This project helps to educate court decision makers about the requirements of the act.
