Your Honor, if it please the court, the Government would establish that Mr.
Jorge Domínguez was a citizen of the
Dominican Republic
,
having been born there in 1970. He initially entered the
United States
legally with his
parents and siblings on an immigrant visa in 1985. He was subsequently deported from the United States on January 15, 1993 following his conviction and
resultant incarceration in New York State the preceding year for the sale of a controlled substance, namely
cocaine. On October 24th of last
year, Mr. Domínguez was arrested and
detained in Wilmington, Delaware where he was charged with the
sale of heroin to an undercover state trooper. INS then proceeded to compare
his fingerprints, through FBI data banks, with those of the individual who
had been deported in 1993, and it was confirmed that they were one and the
same person. INS obtained his
immigration file and established that he was in fact born in the Dominican Republic. Furthermore, they confirmed his 1985
legal entry into the U.S., his 1992 conviction for an aggravated felony, and the deportation arising
from that conviction. The INS would
further prove that he had neither submitted an application for nor been
granted permission to reenter the United States.
