Practice Area: Standardized Civil Protection Order Elements

Date of Implementation: 1995

Overview: The Florida Supreme Court has implemented a rule to require the use of standard forms when issuing injunctions for protection.  The goal is statewide uniformity to promote good judicial practice and assist law enforcement with training and enforcement of the orders.

Key Elements:

  • Involve clerks of court, judges, court staff, and law enforcement in developing the mandatory forms.

  • Allow court staff time to implement standardized forms before making them mandatory.

  • The forms are straightforward and easy to understand, containing only the necessary information for a judicial determination of whether to issue the injunction.

Evaluation:  Evaluation data currently not available.  Reports from courts suggest that there was some initial shock and confusion over how to use the form, but most judges subsequently have found them to be helpful, especially judges who do not routinely enter these injunctions.

Other Support: Law enforcement reports that the standard form has been very beneficial in training and enforcement.
