Key Elements:
-
Preparation of the petition and
filing procedures. The State’s Attorney employs victim advocates who
assist in the preparation and filing of a petition for an order of
protection and bring victims to court for the hearing.
-
Linkages with comprehensive victim
advocacy and services. Victim advocates from the State Attorney’s Office
assist victims in obtaining shelter or other services that may be
needed on an emergency basis.
-
Procedures for
emergency hearings and orders.
Emergency
hearings are taken to one of the available associate judges as soon as
the petition is prepared. A limited emergency hearing is held on an
expedited basis. These emergency hearings result in an order that
lasts for a time period of 14-21 days wherein the respondent is served
and a second hearing is held to determine if a two-year or plenary
order will be entered.
-
Standardized civil protection order elements. A
standardized order of protection is used throughout the Eleventh
Judicial Circuit to process domestic violence cases through the court
system. Orders for protection are entered into the Illinois Law
Enforcement Agency Data System (LEADS) which can be accessed by any
law enforcement agency within the state.
