Practice Area: Mechanisms to Monitor and Enforce Compliance with Order

Date of Implementation: 1999

Overview:  The practice requires the respondent to provide proof of compliance with court ordered treatment.

Key Elements:

  • Respondent has the burden of providing proof of compliance with court orders to the court’s domestic violence coordinator.

  • If respondent fails to provide the required documentation/verification, an order is generated automatically directing either compliance, or an explanation for non-compliance. If neither is received, contempt proceedings are instituted.

  • Cooperation of all facets of the court and of the service community are critical.
