Juror Discussions of Evidence During the Trial

Overview

The Center for Jury Studies

The issue of whether or not to allow jurors to discuss the evidence while a trial is still going on is among the most contentious jury innovations being discussed in the modern court.  By allowing jurors to discuss the evidence before the trial has finished, the hope is that juror comprehension will be enhanced and their interest in the case will increase.  In theory, discussion will lead to more accurate verdicts with faster, more efficient deliberation processes.  However, there is a great deal of contention as to whether or not juror discussions of evidence during the trial are a positive idea.

This module seeks to explore the issue of juror discussions during the trial, its advantages, and its disadvantages.
